PROCEDURES
Rules related to this Policy will be made available in writing as a part of each student's registration process. The rules shall be reviewed with students by the Principal ofeach building at the beginning of the school year and then by the Coach/Advisor at the beginning of each season/activity in which the student participates. An "Authorization to Test for Controlled Substances" agreement shall be signed by each student and his/her parent/guardian before the student will be allowed to participate in an extracurricular activity. The Policy shall be in effect the entire school year in which the student is enrolled at the Elgin School District in grades 6-12 and will govern the conduct of the extracurricular participant. Consequences for violations during the current school year will continue in to the next school year if necessary.
1.0 CONSENT
Each student involved in any extracurricular program(s) shall be required to provide a signed "Authorization to Test for Controlled Substances" agreement prior to joining the program. Both student and parent/guardian signatures are required.
2.0 NON-PUNITIVE NATURE OF POLICY
Students will not be penalized academically for testing positive for illegal drugs under this Policy, nor will extracurricular controlled substance tests be documented in any student's academic records. The information gathered under this Policy will be disclosed only to criminal or juvenile authorities in order to comply with lawful court orders or subpoenas. In the event of such legal compulsion, the District will notify parents/guardians at least seventy-two (72) hours prior to releasing information.
3.0 TESTING RULES
3.1 Random drug testing will be conducted throughout the school year at the Activity Director/Building Principal's discretion at least three times a year.
3.2 During a random drug test, an average number of students will be tested. The average will be determined according to extracurricular participation numbers.
3.3 If a positive test occurs, the parents/guardians of the student will be notified within 72 hours of the District receiving the results from the drug testing agency.
4.0.PROCEDURES FOR TESTING
4.1 Selection for testing shall be by random selections from a pool of all students who have signed the "Authorization to Test for Controlled Substances" agreement. Precautions shall be established to ensure the integrity and confidentiality of the selection process. No individual involved in the selection process will be able to identify students or to determine the selection of a particular student for testing.
4.2 The Principal at each building or his/her designee will be notified on the day students are selected for testing and will arrange for samples to be taken that same day. If a student is absent on a testing day, the absent student shall be tested on the next available date.
4.3 A student who refuses to provide a sample during a testing period will be considered to have tested positive, with consequences to follow.
4.4 The Elgin School District has chosen urine as the means for drug testing, although a hair drug test could be used if there is suspicion that a student is attempting to cheat on the urine test or if there is suspicion that a student is using an illegal drug. The Elgin School District will make this decision as needed.
5.0 1ST POSITIVE TEST
This will result in a twenty-one (21) calendar day suspension from competition and/or travel with their organization. There will also be two (2) follow up drug tests, one every other week after the first positive test, at the student's own expense. The student must also complete the diversion plan reflected in 6.0 within twenty-one (21) calendar days. If the student fails to complete the diversion plan in this time period, the suspension will continue until all steps are completed and the Compliance Check Off List submitted to a Diversion Committee. The student will be required to attend and participate in all practices while suspended unless advised by testing coordinator or medical authorities.
6.0 DIVERSION PLAN
STEP #1 - The student will gain knowledge concerning the social and medical implications of use by interviewing one law enforcement officer or one medical professional. The student shall keep notes of the interview, to be shared with the Diversion Committee.
STEP #2 - The student shall write a five page research paper (double spaced,12 sized font, I inch margins) discussing and supporting non-use of controlled substances.
STEP #3 - The student shall make an oral presentation intended to reinforce the commitment of the student to his/her team, squad, club, or activity group.
STEP #4 - The student will organize and meet with a Diversion Committee of the student's choice, composed of three of the following four: administrator, teacher, coach, and advisor. The purpose of this meeting is to give the student an opportunity for evaluation of the diversion program. The student shall provide proof to the Diversion Committee at this time of having completed Steps 1, 2, and 3.
STEP #5 - Evaluation by the Diversion Committee of the student's performance in the diversion program and Check Off Lists completed.
7.0 2ND POSITIVE TEST
This will result in a sixty-three (63) calendar day suspension from competition and/or travel with their organization. There will also be two (2) follow up drug tests, one every other week after the first positive test at the student's own expense.
The student must also complete the diversion plan listed in 6.0 within sixty-three (63) calendar days. If the student fails to complete the diversion plan in this time period, the suspension will continue until all steps are completed and the Compliance Check Off List is submitted to the Diversion Committee. In addition, the student must, at his/her own expense, enroll in, and at the first available date, complete the MIP Education Class offered through the Center for Human Development, Inc., LaGrande, Oregon. A detailed description of this program is located at the end of this Policy.
8.0 3RD POSITIVE TEST
This will result in a one (1) calendar year suspension from competition and/or travel with their organization. There will also be two (2) follow up drug tests, one every other week after the first positive test, at the student's own expense. The student must also complete the diversion plan listed in 6.0 within one (1) calendar year. If the student fails to complete the diversion plan in this time period, the suspension will continue until all steps are completed and the Compliance Check Off List is submitted to the Diversion Committee. In addition, the student must, at his/her own expense, enroll in, and at the first available date complete the more serious education classes offered through the Center for Human Development, Inc., LaGrande, Oregon. A detailed description of this program is located at the end of this Policy.
9.0 4TH POSITIVE TEST
This will result in termination of the student's privilege to be a part of any and all extracurricular activities through the Elgin School District for the remainder of his/her high school enrollment.
10.0 ONE TIME ONLY - VOLUNTARY STUDENT ADMISSION
If a student voluntarily admits at the time of the first drug test that he/she will test positive, that student, together with
his/her parent/guardian, will then sign a voluntary student admission form declaring the student positive for a controlled substance and subjecting the student to follow up testing at his/her own expense every other week for two (2) successive tests from the day the student declared him/herself positive. The student will be subject to a fourteen (14) calendar day suspension from competition and/or travel with their organization. The student shall also complete the diversion plan listed in 6.0 within fourteen (14) calendar days. If the student fails to complete the diversion plan in this time period, the suspension will continue until all steps are completed and the Compliance Check Off List is submitted to the Diversion Committee.
11.0 PRESCRIPTION MEDICATION

12.0 SUSPENSIONS
Suspensions carry over from season to season and from one school year to the next, including over the summer. No positive test will follow a student from middle school to high school. Violations are cumulative over the student's high school career. Every student entering Elgin High School for the first time will start with a clean record.
